4. User Responsibility

6. Fees and Payments
Fees are disclosed prior to purchase. Unless otherwise stated, payments are non-refundable. Chargeback abuse may result in termination and legal recovery.

8. Indemnification

9. No Agency Relationship
Use of services does not create partnership, employment, joint venture, fiduciary, or agency relationship.
10. Mandatory Binding Arbitration
All disputes shall be resolved exclusively through binding arbitration under the Federal Arbitration Act in the State of New York. Users waive the right to court proceedings and jury trials.
11. Class Action Waiver
All disputes must be brought individually. Users waive the right to participate in class or collective actions.
12. Jury Trial Waiver
If arbitration is unenforceable, parties waive the right to a jury trial.
13. Intellectual Property
All website content, branding, software, and materials are the exclusive property of Profay.com and protected by intellectual property laws.
14. DMCA Policy
Copyright complaints must be submitted to client@profay.com with required identification, good faith statement, and signature. Repeat infringers may have access terminated.
15. Refund Policy
Profay.com will issue a refund if it fails to deliver agreed-upon consultation services. Refund requests must be submitted within 14 days and allow a 7-business-day resolution period. Refunds are not based on financial or business outcomes.
16. Earnings & Results Disclaimer
We make no guarantees of income, credit approval, funding, or business success. All ventures involve risk. Testimonials are not typical results. Users assume full responsibility for outcomes.
17. Governing Law
These Terms are governed by the laws of the State of New York.
18. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
